Hyena Licensing Restrictions Hyena License Agreement Hyena is licensed on an "AS IS" basis without any warranty of any kind. There is no implied or specified guarantee related to program usage, function, or reliability. The limit of liability for use of this program shall be a complete refund of the original purchase price. Any other costs incurred in the use of this software, including those involving damage and disruption of business, and all risk as to the quality and performance of this software, are entirely borne by the individual(s) or company(s) by which they are employed. Some jurisdictions do not allow warranty exclusions, so this disclaimer may not be applicable to you, and you may have additional legal rights that are specific to your jurisdiction. You may use this program free-of-charge for 30 days after installation. After this time, you must register and pay for its continued use. Registration instructions can be found in the online help. Upon registration and receipt of payment, you or your organization will receive a license access ID that will grant you the right to use the registered version of the product indefinitely. The act of using this program, and any associated utilities, implies acceptance of this agreement both by you and any organization that you represent or belong to. Single-user, 3-user, and 5-user Licenses Single, 3-user, and 5-user licenses grant the use of Hyena only for the respective number of concurrent users. The multi-user license levels may be shared between multiple business divisions and time zones. Site License A site license allows an unlimited number of users to use Hyena, as long as all users are physically located at the same site. A "site" is defined as a contiguous piece of real estate, including land, buildings, and multi-story complexes. A typical university or business campus environment, involving multiple buildings, would still be considered a single site. Note: Occasional use of Hyena by dialup and remote access does not violate the spirit of the site contract and it thereby permitted, as long as the dialup access is not a continuous and ongoing remote administration function. A site license can be legally transferred to another entity during a merger or purchase of the business entity for which it was originally purchased. Corporate Enterprise License A Hyena corporate enterprise license allows an unlimited number of users to use Hyena, as long as all of the users work for the same corporate entity or a legal wholly owned subsidiary. There are not any geographic boundaries to a corporate license; the licensed entity can reside on multiple continents. A corporate enterprise license can be legally transferred to another entity during a merger or purchase of the business entity for which it was originally purchased. License Upgrades The cost of an upgrade to any existing Hyena license is the current retail price of the new license, less the current retail price of the current license. For example, June 1 - purchase 5-user license of Hyena for $399 July 1 - purchase price of 5-user license increased to $499 August 1 - upgrade to a $999 site license Using the above example, the upgrade price would be $500 ($999 - 499). Year 2000 Compliance Adkins Resource warrants its products to be compatible with dates and times that refer to the 21st century, as long as the underlying operating system also supports these dates and times. In the case of Windows NT (R), for example, there is an operating system-imposed limit to the year 2036. Software Distribution This software may be distributed in electronic forums, bulletin boards, and Internet sites, so long as: It is distributed in the original, complete, unregistered format with an initial 30-day trial period.
